Terms of Service

By accessing and using the Lake Street Design Co. website and services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms of Service ("Terms") govern your use of our website located at lakestreet.design (the "Service") operated by Lake Street Design Co. ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

Lake Street Design Co. provides architectural and interior design services including:

• Residential architecture and custom home design
• Interior design and space planning
• Commercial design services
• Renovation and remodeling design
• Landscape architecture
• Design consultation services

Service Agreements

All design services are subject to separate written agreements that will specify:

• Scope of work and deliverables
• Project timeline and milestones
• Fee structure and payment terms
• Responsibilities of both parties
• Intellectual property rights

Our Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Lake Street Design Co. and its licensors. The Service is protected by copyright, trademark, and other laws.

Design Work

All architectural plans, interior designs, and related creative work produced by Lake Street Design Co. remain our intellectual property until full payment is received, at which point specified usage rights transfer to the client as outlined in the project agreement.

Client Materials

Clients retain ownership of any materials, images, or content they provide to us. By providing such materials, clients grant us a license to use them solely for the purpose of providing design services.

Portfolio Rights

Unless otherwise specified in writing, Lake Street Design Co. reserves the right to photograph completed projects and use such images for marketing, portfolio, and promotional purposes.

When using our website and services, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Use the Service only for lawful purposes
• Respect intellectual property rights
• Not attempt to gain unauthorized access to our systems
• Not use the Service to transmit harmful or malicious content

Prohibited Uses

You may not use our Service:

• For any unlawful purpose or to solicit others to unlawful acts
• To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• To submit false or misleading information

Fee Structure

Design service fees are determined based on project scope, complexity, and timeline. All fees will be clearly outlined in the project agreement before work begins.

Payment Schedule

• Initial consultation: Complimentary for qualified projects
• Design retainer: Due upon signing of design agreement
• Progress payments: As outlined in project milestones
• Final payment: Due upon project completion

Late Payments

Late payments may result in project delays and additional fees. Work may be suspended if payments become significantly overdue.

Lake Street Design Co. provides design services and recommendations. We are not responsible for:

• Construction defects or contractor performance
• Building code compliance (client responsibility to verify)
• Structural engineering (unless specifically contracted)
• Permit acquisition (unless specifically contracted)
• Final material selection changes made without our consultation

Our liability is limited to the amount paid for our design services. We recommend clients work with licensed contractors and obtain appropriate permits and inspections.

Design Revisions

Each project includes a specified number of design revisions. Additional revisions beyond this scope will be billed at our current hourly rate.

Project Scope Changes

Significant changes to project scope may require a new agreement and adjusted timeline. We will provide written estimates for any scope changes before proceeding.

Client-Requested Delays

Project timelines may be adjusted for client-requested delays. Extended delays may result in additional fees to maintain design team availability.

Either party may terminate a design agreement with written notice. In case of termination:

• Client will be billed for all work completed to date
• Lake Street Design Co. will provide all work completed up to termination date
• Unused retainer fees will be refunded after final billing
• Intellectual property rights remain with Lake Street Design Co. until full payment

We reserve the right to terminate agreements for non-payment, breach of contract, or if project requirements exceed our capabilities.

These Terms shall be interpreted and governed by the laws of the State of Minnesota, United States. Any disputes shall be resolved in the courts of Hennepin County, Minnesota.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
